Terms + Conditions

Effective date: October 2026  ·  Version 1.0

Please read these Terms carefully. They are a binding agreement between you and 24 Rescue Services LLC. By using our website, placing an order, activating a device or using our monitoring service, you agree to them. If you don't agree, please don't use our website or Services.

Plain-language summary

This summary highlights the key points. It doesn't replace the full Terms below; if the two ever differ, the full Terms control.

  • What you get: a wearable alert device and 24/7 monitoring. Press the button (or let fall detection trigger) and a trained agent speaks with you, contacts your emergency contacts and calls 911 when needed.
  • Not a replacement for 911: if you can call 911 yourself in an emergency, do. Fall detection does not catch every fall.
  • Billing: monthly, or yearly in advance at 20% off. Billing renews automatically each period until you cancel.
  • Activation fee: a one-time fee to set up and activate your service. The device stays the property of 24 Rescue Alert.
  • Minimum term: 3 months, billed monthly, then month to month. Waived during the 30-day trial and if the user passes away or moves into a care facility.
  • Cancel by phone at (844) 973-2424 or in writing. When you cancel, return the device within 30 days or a $300 non-return fee applies.
  • Try it risk-free: cancel within 30 days of receiving your device and get a full refund of your monitoring fees and activation fee, with a free return label.
  • Your data: in an emergency we share your name, address, location and the health notes you gave us with 911 and your contacts. We never sell your personal information.
  • Calls and texts: we may contact you about your account and safety. Marketing messages need your separate consent. Reply STOP anytime.
  • Disputes: call us first. If we can't fix it within 30 days, disputes go to individual arbitration under Texas law, not a jury trial or class action.

1. About these Terms

These Terms and Conditions ("Terms") are a legal agreement between you ("you," "your," "Customer") and 24 Rescue Services LLC, a Texas limited liability company doing business as 24 Rescue Alert ("24 Rescue Alert," "we," "us," "our"), located at 10103 Fondren Rd, Houston, TX 77096.

These Terms cover:

Our Privacy Policy, your order confirmation and any Service Agreement you sign are part of these Terms. If you sign a Service Agreement and it conflicts with these Terms, the signed Service Agreement controls. If you enroll someone else, such as a parent, you confirm you have the authority to accept these Terms for them.

2. Who can use the Services

2.1 Age

You must be at least 18 and legally able to enter a contract. A person under 18 may use a Device only if a parent or legal guardian enrolls and accepts these Terms for them.

2.2 United States only

The Services are offered only to people living in the United States. Devices and monitoring may not work, or may not be legal to use, outside the U.S.

2.3 Accurate information

You agree to give us accurate, complete information and keep it current, especially your address, emergency contacts and any health notes. Responders rely on this information. Keep any account login private and tell us right away at [email protected] if you think someone has accessed your account. We aren't responsible for problems caused by outdated or incorrect information.

2.4 Enrolling on behalf of someone else

If you enroll a parent, spouse or other person (the "User"), you confirm that you are authorized to act for them, that the information you give about them is accurate, and that you may make decisions about their service, Device settings and emergency contacts.

3. The Services

3.1 How monitoring works

Monitoring is provided 24 hours a day, 365 days a year by trained agents at a professional monitoring center we contract with. When your Device sends an alert, an agent may, using their judgment: try to speak with you through the Device or by phone; contact your emergency contacts in the order you set; and call 911 or local emergency services when the situation calls for it. You can always call 911 directly instead of, or in addition to, using the Device.

3.2 Fall detection

Both current Devices include fall detection. Fall detection does not detect every fall and may occasionally trigger when no fall occurred. It is an extra layer of protection, not a substitute for pressing the help button. If you are able to press the button, always do. We are not responsible for falls or emergencies that fall detection does not detect.

3.3 Coverage, charging and device limits

Features such as location accuracy, water resistance, battery life and two-way voice vary by Device; see the product details for your model. The Services rely on third-party cellular networks, and we can't guarantee uninterrupted service. Coverage gaps, network outages, signal interference, power failures and similar issues outside our control can prevent an alert from going through. Keeping your Device charged is your responsibility; a Device with a dead battery cannot send alerts.

3.4 Insurance and benefits

Some health plans or benefit programs may cover part of the cost of medical alert services. Coverage decisions are made only by your plan. We don't guarantee coverage or reimbursement, and you are responsible for checking your eligibility. Original Medicare generally does not cover medical alert systems.

4. Orders, pricing and payment

4.1 Orders

Your order is confirmed only when we send you a written order confirmation. We may decline or cancel an order, for example for a pricing error, suspected fraud or lack of availability. We may ask for extra verification before processing an order.

4.2 Rates and activation fee

Your monthly service rate, and any rate guarantee that applies to your plan, are stated in your order confirmation. Taxes, government fees and optional add-ons you choose later are separate. If your service is cancelled and later restarted, current pricing applies to the new service.

Your service includes a one-time activation fee, shown in your order confirmation, which covers setting up, programming and activating your Device and service. The activation fee does not purchase the Device; Devices remain the property of 24 Rescue Alert as described in Section 6.1. The activation fee is refunded in full if you cancel within the trial period in Section 5.5, and is non-refundable after that.

4.3 Automatic renewal

Automatic renewal notice: your service is billed monthly or, if you choose annual billing, yearly in advance at a 20% discount off the monthly rate, and renews automatically at the end of each billing period until you cancel under Section 5. By enrolling, you authorize us to charge your payment method on file for each renewal period. Before your first charge, we will clearly tell you the price, billing frequency and how to cancel, and get your consent to automatic renewal.

4.4 Prepaid plans

If you choose annual billing and cancel after the minimum term, we will refund the unused portion on a prorated basis, less any restocking fee, after your cancellation is confirmed and any leased Device is returned. Monthly plans are not refunded for partial months unless the law requires it.

4.5 Payment

We accept major credit and debit cards and ACH bank transfers. You confirm you are authorized to use the payment method you provide. If a payment fails, we will retry it automatically and notify you by text, email and phone. Because the Services protect your safety, we suspend service only after 30 days of non-payment, and we send a final notice at least 7 days before suspension. We do not charge late fees, and reconnection is free if your balance is paid within 60 days of suspension. We are not responsible for fees your bank charges.

4.6 Taxes

You are responsible for applicable taxes and government fees, which we collect and pay where the law requires. Your order confirmation shows any taxes that apply.

4.7 Promotions and trials

Promotions, discounts and trial periods are subject to the terms shown when offered. Unless stated otherwise, a trial converts to paid service at the end of the trial if you don't cancel. Promotions can't be combined or exchanged for cash unless stated.

4.8 Protection Plan

The optional Protection Plan costs $6.99 per month, billed with your service, and can be added or removed anytime. While enrolled, it covers: replacement of a Device that is lost, stolen or damaged (including accidental damage); replacement chargers, lanyards, straps and clips; and the rate guarantee stated in your order confirmation. Replacement Devices remain our property. We may limit replacements for repeated losses, and the Protection Plan does not cover intentional damage.

5. Term, cancellation and returns

5.1 Minimum term

Service has a minimum term of three (3) months, starting on the earlier of your first successful payment or the date service begins, and continues month to month after that. You are billed monthly during the minimum term; nothing beyond your first month and activation fee is charged upfront. If you cancel after the trial period in Section 5.5 but before the end of the minimum term, the remaining monthly payments within the minimum term are due. The minimum term does not apply, and no remaining payments are due, if the User passes away or moves into a nursing home, assisted living or other care facility; we may ask for reasonable documentation.

5.2 How to cancel

We will confirm your cancellation in writing. Service continues through the end of your current paid billing period. Cancellation takes effect once we receive the Device, as described in Section 5.3.

5.3 Returning your Device

5.4 Activation fee on cancellation

Paying the activation fee does not give you ownership of the Device. Whenever you cancel, the Device must be returned as described in Section 5.3. The activation fee is refunded only for cancellations within the trial period in Section 5.5.

5.5 30-day risk-free trial

If you cancel and return a new Device within 30 days of receiving it, we will refund your monitoring fees and activation fee in full and send you a free prepaid return label. The minimum term in Section 5.1 does not apply to cancellations within the trial period. Devices must be returned undamaged with all accessories. This window may not apply to promotional or refurbished Devices where stated.

5.6 Cancellation by us

We may suspend or end the Services for non-payment, a violation of these Terms, fraud, false information, repeated non-emergency alarms, or abusive conduct toward our staff or monitoring agents. We will give notice when practical. We are not responsible for any loss that happens after Services end. Restarting service is at our discretion and may require a reconnection fee.

5.7 Your rights under state law

Some states give consumers additional rights for cancellations, refunds and automatic renewals. Nothing in these Terms takes away any right you have under the law of your state; where your state's law requires something different, that law applies to you.

6. Devices and equipment

6.1 Devices remain our property

Devices are leased to you for use with the Services and remain our property at all times. Please take reasonable care of them. Don't open, modify or attempt to repair a Device, remove its serial number, use it for anything other than its intended purpose, or give it to someone else.

6.2 Activation fee and ownership

All Devices are provided for use with the Services and remain our property. The activation fee covers setup and activation only and does not transfer ownership of the Device to you.

6.3 Updates and compatibility

We or the manufacturer may send software updates to your Device, some automatically. Caregiver app features need a compatible smartphone. Reduced functionality caused by declining updates or using an unsupported phone is not our responsibility.

6.4 Accidental and false alarms

Accidental button presses happen and are not penalized. If non-emergency alarms become a repeated pattern, we will work with you on solutions and may charge reasonable fees as permitted by law. You are responsible for any false-alarm fines charged by a city, county or other government agency.

6.5 Lost, stolen or damaged Devices

Tell us right away at (844) 973-2424 if your Device is lost, stolen or damaged so we can protect your account and get you a replacement. Replacement of a leased Device that is lost or damaged may cost up to $300.00, or is covered at no charge if you are enrolled in the Protection Plan in Section 4.8. Defects covered by the warranty in Section 7 are replaced at no charge.

7. Limited warranty

7.1 What's covered

We warrant that new Devices will be free from defects in materials and workmanship under normal use for as long as your monitoring service remains active (the "Warranty Period"). The warranty applies to the original customer and can't be transferred.

7.2 What isn't covered

7.3 How we fix it

If a covered defect occurs during the Warranty Period, we will repair or replace the Device, at our choice, with a new or refurbished unit that works at least as well. Contact us at (844) 973-2424 or [email protected]. We may ask for a description of the problem and the return of the defective Device. A replacement Device is covered for the rest of the original Warranty Period or 90 days, whichever is longer.

7.4 Disclaimer of other warranties

EXCEPT FOR THE LIMITED WARRANTY ABOVE, THE DEVICES AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE EXTENT THE LAW ALLOWS. SOME STATES DON'T ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.

8. Emergency disclaimer and limits of liability

24 RESCUE ALERT IS NOT A SUBSTITUTE FOR CALLING 911 OR FOR PROFESSIONAL MEDICAL CARE. IF YOU CAN CALL 911 IN AN EMERGENCY, DO SO. WE CANNOT GUARANTEE RESPONSE TIMES, THE AVAILABILITY OF EMERGENCY SERVICES, OR ANY OUTCOME.

8.1 What the Services are

The Services are a notification and communication service. We are not an ambulance service, first responder, hospital or healthcare provider, and we don't send our own emergency personnel. Our role is to receive alerts and notify the responders and contacts described in Section 3.1. We have no control over how quickly, or whether, 911, police, fire, EMS or your emergency contacts respond.

We are not responsible for: the failure or delay of any emergency responder or emergency contact; interruptions caused by power, equipment, cellular networks or other causes outside our reasonable control; or anything that happens after the Services have ended.

8.2 Limit on our liability

TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THESE TERMS, THE DEVICES OR THE SERVICES, UNDER ANY LEGAL THEORY (INCLUDING NEGLIGENCE), WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SERVICES IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) TWO HUNDRED FIFTY DOLLARS ($250.00).

8.3 No indirect damages

TO THE FULLEST EXTENT ALLOWED BY LAW, NEITHER WE NOR OUR OWNERS, EMPLOYEES, AGENTS, MONITORING CENTER OR SUPPLIERS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING PERSONAL INJURY, DEATH, LOST PROFITS OR PROPERTY DAMAGE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. SOME STATES DON'T ALLOW THESE LIMITS, SO THEY APPLY TO YOU ONLY AS FAR AS YOUR STATE'S LAW PERMITS.

8.4 Why these limits exist

Our prices are based on providing a notification service, not on insuring your safety or property. You agree these limits are a fair allocation of risk and an essential part of our agreement, and that we would not offer the Services at these prices without them.

8.5 Events beyond our control

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, fire, pandemics, war, terrorism, government action, labor disputes, power or telecommunications failures, cyberattacks or cellular network outages. Our obligations are paused while the event lasts.

9. Calls, texts and emails

9.1 Your consent

When you give us your phone number, you agree that we, and service providers acting for us, may contact you at that number, including with automated technology, about:

Consent to marketing is never a condition of purchase.

9.2 Text message terms

9.3 Email

We may email you about your account, service and, unless you opt out, news and offers. Every marketing email includes an unsubscribe link. Account, billing and safety emails will still be sent after you unsubscribe from marketing.

9.4 Call recording

Calls with us and with the monitoring center may be recorded for quality, training, verification and emergency-response purposes. We will tell you at the start of a recorded call; by staying on the call, you agree to the recording.

9.5 Automated and AI-assisted communications

Some of our calls, texts or emails may be sent or assisted by automated or AI tools. Automated calls will identify themselves as automated, and you can always ask to speak with a person. Information from an automated tool may contain mistakes; any price, offer or term is binding only when confirmed in your written order confirmation.

9.6 Do-not-call requests

We keep an internal do-not-call list. To be added, call (844) 973-2424 or email [email protected]. Do-not-call requests do not apply to calls about active service, your account, safety, or calls you have consented to.

10. Your information

10.1 Privacy Policy

How we collect, use and protect your information, including health and location information, is explained in our Privacy Policy, which is part of these Terms.

10.2 Sharing in an emergency

When an alert is triggered, you authorize us and our monitoring center to share your name, address, Device location and the health information you gave us with 911 and emergency dispatch, police, fire and EMS responders, and your emergency contacts, solely to help get you assistance. This sharing is an essential part of the Services. We are not responsible for outcomes caused by inaccurate information you provided.

11. Caregiver app

Where included with your Device, we give you a personal, limited, non-transferable and revocable right to use the caregiver app while your service is active. You may invite family members or caregivers to view information such as alerts, location and battery status, and you may remove their access at any time. People you invite must accept the app's terms. We are not responsible for what authorized caregivers do with the information you share with them.

You agree not to: copy, resell or modify the app or Site; reverse engineer any software; use the Services for anything illegal; introduce malware or try to access systems or accounts without permission; scrape data from the Services; use the Services to track someone without their knowledge and consent; or pretend to be someone else.

12. Intellectual property

The 24 Rescue Alert name, logo, website design, text and graphics belong to 24 Rescue Services LLC or its licensors. Device names, designs and product images belong to their respective owners and are used with permission. You may not use our name or logo without our written permission. If you send us suggestions or feedback, we may use them without any obligation to you.

If you believe content on the Site infringes your copyright, send a notice to [email protected] or 10103 Fondren Rd, Houston, TX 77096 identifying the work, the material you believe infringes and where it appears, your contact information, a statement of good-faith belief, and a statement, under penalty of perjury, that your notice is accurate.

13. Website content and medical disclaimer

We work to keep the Site accurate, but product details, availability and other information may contain errors and may change without notice. Errors on the Site don't create obligations for us; your order confirmation governs your purchase.

Medical disclaimer: information on the Site and in our communications is for general information only and is not medical advice, diagnosis or treatment. Talk to your doctor about any medical questions. In a medical emergency, call 911.

Links to other websites are provided for convenience; we don't control them and aren't responsible for their content or practices. If you send us a review or testimonial, you allow us to use and display it, with your name as you provide it, in our marketing, and you confirm it reflects your honest experience.

14. Indemnification

To the extent the law allows, you agree to defend and hold harmless 24 Rescue Services LLC and its owners, employees, agents and service providers from claims, losses and costs (including reasonable attorneys' fees) arising from: your misuse of the Site, Devices or Services; failure to keep your Device charged or to allow necessary updates; violation of these Terms or the law; inaccurate information you provided; unauthorized use of your account that results from your failure to protect it; or content you submit to us.

15. Disputes and arbitration

15.1 Talk to us first

If you have a problem, contact us at [email protected] or (844) 973-2424, or write to 24 Rescue Services LLC, Attn: Disputes, 10103 Fondren Rd, Houston, TX 77096. We will try to resolve it within 30 days. Both sides agree to try in good faith to resolve a dispute this way before starting arbitration.

15.2 Binding arbitration

If a dispute isn't resolved within 45 days after we receive your written notice, you and we agree to resolve it by final, binding arbitration instead of in court, except as stated in Section 15.4. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single neutral arbitrator. Hearings may be held by phone, video or in the county where you live. For consumer claims, we will pay the arbitration filing and administrative fees required by those rules, and we will not seek attorneys' fees from you unless the arbitrator finds your claim frivolous. You and we each give up the right to a trial by jury.

15.3 No class actions

CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. IF A DISPUTE IS DECIDED IN COURT FOR ANY REASON, BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL.

15.4 Exceptions

Either party may bring an individual claim in small claims court if it qualifies, and either party may ask a court for emergency or injunctive relief to prevent irreparable harm.

15.5 Governing law and venue

These Terms are governed by the laws of the State of Texas and the Federal Arbitration Act, without regard to conflict-of-law rules. Any matter not subject to arbitration will be heard in the state or federal courts located in Harris County, Texas. If the consumer protection laws of your state give you greater rights, those rights still apply.

15.6 Time limit for claims

To the extent the law allows, any claim must be brought within one year after it arises, or it is permanently barred.

16. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new effective date and, for material changes affecting active customers, notify you by email or text at least 30 days before they take effect. If you don't agree with a change, you may cancel under Section 5 before it takes effect. Continuing to use the Services after that date means you accept the updated Terms. Changes will never override a rate guarantee stated in your order confirmation.
